DATA PROTECTION LAW

A. General Explanations

Under the Personal Data Protection Law No. 6698 (“KVKK”), personal data owners defined as data subjects (“Applicant”) are granted certain rights under Article 11 of the KVKK regarding the processing of their personal data.

Pursuant to paragraph 1 of Article 13 of the KVKK, applications to our Company, as the data controller, regarding these rights must be submitted to us in writing, bearing a wet signature, or through other methods determined by the Personal Data Protection Board (“Board”), namely via the Applicant’s registered electronic mail (“KEP”) address, secure electronic signature, mobile signature, the electronic mail address previously notified by the data subject to the data controller and registered in the data controller’s system, or through software or an application developed for the purpose of submitting such applications.

In this respect, for written applications to be submitted to our Company, a printed copy of this form may be used, and the Applicant may submit an application to us:

  • in person, in writing and with a wet signature; or
  • through a notary public.

The Applicant may also submit an application digitally by sending this form, or a form prepared by the Applicant containing the mandatory information requested herein, to us through one of the following methods:

a) via the Applicant’s registered electronic mail (KEP) address;

b) by signing it with a secure electronic signature;

c) by signing it with a mobile signature; or

d) via the electronic mail address previously notified by the Applicant to us and registered in our system.

Furthermore, once any other methods to be determined by the Board are announced, our Company will also announce how applications may be received through such methods.

Applications submitted to us shall be responded to within 30 days from the date on which your request is received by us, depending on the nature of the request, pursuant to paragraph 2 of Article 13 of the KVKK. Our responses shall be delivered to you in writing or electronically in accordance with the relevant provision of Article 13 of the KVKK.

This application form has been prepared in order to identify your relationship with our Company, to fully determine your personal data processed by our Company, if any, and to ensure that your relevant application is responded to accurately and within the statutory period. In order to eliminate legal risks that may arise from unlawful and unfair data sharing, and particularly to ensure the security of your personal data, our Company reserves the right to request additional documents and information, such as a copy of your identity card or driver’s license, for the purposes of identity and authority verification. Our Company shall not accept any liability for requests arising from incorrect information or unauthorized applications in the event that the information regarding your requests submitted within the scope of this form is not accurate and up to date, or if an unauthorized application is made. If the transaction to be carried out upon your request requires an additional cost, a fee may be charged as set forth in the COMMUNIQUÉ ON THE PROCEDURES AND PRINCIPLES OF APPLICATION TO THE DATA CONTROLLER. A processing fee of TRY 10 may be charged for each page exceeding ten pages. If the response to your application is required to be provided on a recording medium such as a CD or flash drive, the fee corresponding to the cost of such recording medium may be requested from you.
